fill the store with items created by womyn, for womyn.  If you create
something, we would love to see it.  Please see our consignment contract
below, and then come by the store to fill one out.

1.  The Artist, Artisan, Author, or Musician (hereafter designated as Consignor)
represents and warrants to The Spiral Dance Womyn’s Bookstore that they are the
owner of the consigned work, and that it does not violate any copyright or other rights
of any third party, and that the Consignor is free to enter into this agreement without
the violation of any contractual or copyright obligations the Consignor may have.  
Consignor acknowledges that The Spiral Dance Womyn’s Bookstore is relying on this
representation and warranty in accepting the items that are consigned under this
contract.

2. The Consignor, by execution hereof represents, covenants, and warrants that none
of the claims released herein have been in any manner conveyed, assigned or
transferred, or purported to be conveyed, assigned or transferred, in whole or in part,
to any third party, and that no person or entity has been subrogated to the rights,
claims or interests of the Consignor.

3.   The Consignor, in consideration of the execution of this contract,  hereby
irrevocably and unconditionally releases, remises, cancels, acquits and discharges
The Spiral Dance Womyn’s Bookstore from any and all claims, rights, demands,
damages, debts, liabilities, controversies or causes of action of any nature
whatsoever, known or unknown, asserted or unasserted, liquidated or unliquidated,
fixed or contingent, of any nature whatsoever, relating to or arising, directly or
indirectly, out of the occurrences of this Contract.

4.  The Consignor hereby agrees to indemnify, defend and forever hold The Spiral
Dance Womyn’s Bookstore harmless from any and all liability, of any kind or character,
including attorney fees and expenses that may be incurred by The Spiral Dance
Womyn’s Bookstore or any of its representatives, employees or agents arising out of
or in any manner related to the consigned items covered by this contract.

5.  The Consignor may withdraw any or all unsold consigned items in this contract by
appearing in person at The Spiral Dance Womyn’s Bookstore to sign a Contract
Termination and receipt for unsold consigned items.  The Spiral Dance Womyn’s
Bookstore is NOT obligated to incur any costs in order to return consigned items to the
Consingor.   

6.  The Consignor is responsible for establishing the retail selling price of each and
every item placed on consignment in this Contract.

7.  The Consignor hereby understands and agrees that The Spiral Dance Womyn’s
Bookstore will withhold 25% of the retail selling price of sold items in this contract for
its own profit.

8.  The Spiral Dance Womyn’s Bookstore agrees to pay the Consignor 75% of the retail
selling price on sold items contained within this contract, within 30 days of the selling
date.

9.  The Spiral Dance Womyn’s Bookstore shall pay all expenses associated with the
sale of consigned items within The Spiral Dance Womyn’s Bookstore, located at 2505
E. Oliver St., Baltimore, MD, and no other location.  The Spiral Dance Womyn’s
Bookstore is under no obligation to provide any promotional materials or advertising
for any consigned item contained in this contract.

10.  The Spiral Dance Womyn’s Bookstore assumes no responsibility whatsoever for
the loss of, damage to, or destruction of any item contained in this contract, for any
reason.  

11.  This Contract shall be binding upon and inure to the benefit of the Consignor and
The Spiral Dance Womyn’s Bookstore only.  There are no third party beneficiaries.

12.  All parties hereto represent, covenant and warrant that they have read this
Contract and fully understand it; that they have executed this Contract with the intent to
be fully bound according to its terms, that in signing this Contract, they have relied
solely on their own knowledge or their own duly authorized representatives’
knowledge.  No party to this Contract acted under duress or was otherwise forced to
execute this Contract.
